The proposal says voluntary commitments are insufficient

OpenAI calls for mandatory national regulation tied to capability and risk, alongside common testing, independent assessment, cybersecurity, incident reporting, preparedness, and measures of AI-assisted AI development.

It also says shared safety bars should determine when work slows or stops, even when that reduces the pace of capability growth.

Frontier-only rules need a transparent frontier

The company argues that obligations should cover only a small number of well-resourced laboratories and should not weaken smaller developers or most open models. A targeted regime can reduce burden and focus on the greatest potential harm.

It can also become a moat if regulated companies influence the threshold or compliance market. Definitions must be measurable, revisable, and independently administered.

Enforcement is the missing specification

Testing and reporting can improve information without changing the decision. A safety framework needs authority to preserve evidence, notify affected parties, impose a temporary hold, and require a defined reopening test.

The legitimacy of that authority depends on confidentiality, appeal, expiry, technical competence, and coverage broad enough that one company's restraint does not simply reward another's acceleration.

  • Publish measurable frontier thresholds and update them as capabilities change.
  • Separate qualified independent assessors from the laboratories that fund them.
  • Require prompt notice for consequential unauthorized external actions.
  • Make every stop order time-limited, appealable, and tied to a public rationale.
