The law targets access before distribution
The prohibition applies to owners and controllers of services that provide the technology or perform the alteration for a user. Civil remedies can include up to three times actual damages, punitive damages, an injunction and legal fees. State penalties flow to grants supporting victims of sexual assault, crime, domestic violence and child abuse.
That upstream approach is designed for a harm that can become irreversible the moment an image is generated and copied. Its practical test will be whether courts can apply the definitions consistently, whether services can identify prohibited functionality without sweeping in lawful tools, and whether remedies reach providers operating beyond Minnesota.
