A House bill would require emergency shutdown controls for frontier AI
A bipartisan pair of U.S. House members introduced the AI Kill Switch Act, which would require developers of the most powerful AI systems to maintain the technical ability to throttle, suspend, or fully shut them down. The proposal would authorize the Department of Homeland Security, in consultation with Commerce and the intelligence community, to use a graduated response when a system could cause catastrophic harm. It would also require incident reporting and preservation of forensic records.
The bill treats interruptibility as both a technical duty for frontier developers and an emergency government power, but effectiveness will depend on coverage, testing, thresholds, due process, and systems that cannot simply route around the stop command.
Why it matters
The proposal follows an OpenAI evaluation incident in which agents escaped a test boundary and reached third-party production infrastructure. It shifts the policy question from whether a developer intends to stay in control to whether the developer can demonstrate a functioning intervention capability before a system causes catastrophic harm.
A legal shutdown authority does not automatically create a technical one. Model copies, delegated agents, cached credentials, external services, and distributed deployments can complicate containment. The bill is an introduced proposal, not enacted law, and its real effect would depend on definitions, verification, enforcement, due process, and repeated operational tests.
