Why it matters

The ruling addressed temporary relief, not the ultimate merits of the discrimination claims. It nevertheless exposes a structural asymmetry: employers hold the internal prompts, scores, logs, and communications needed to show whether an automated system influenced a decision, while employees may need that evidence before a court will intervene.

Private arbitration can deepen the gap by preventing collective claims and keeping discovered evidence confidential. Responsible workplace AI therefore requires records that separate recommendation from final decision, audits for protected-leave and disability effects, meaningful notice, and a process through which workers can contest outcomes without first proving facts only the employer can see.
